Preventative workplace initiatives provide the solid foundation of our Employment Law Practice Group. We use our industry knowledge to provide our clients with practical advice and proactive strategies designed to both ensure compliance and manage litigation risk.
This experienced team provides confidential audits of policies to promote compliance with state and federal laws of all kinds and develops suitable common-sense strategies for satisfying regulatory standards and compliance standards. On site reviews and training of key personnel are critical to the mission of staying in compliance and preventing costly, disruptive and distracting governmental investigations and employee litigation.
FKP regularly designs and present training programs tailored to individual client needs and have developed personnel audits to assist employers in complying with various employment laws and minimize their exposure to class action litigation. We have broad experience reviewing and drafting all forms of employment policies and procedures, handbooks, applications, performance evaluation forms, offer letters, employment contracts and all other documents that have an impact on the employment relationship. We also conduct comprehensive employment audits to expose problem areas before they become legal challenges.
FKP works closely with clients to:
- Develop workplace safety programs
- Draft policies concerning leaves of absence and reasonable accommodation and related issues in compliance with the ADA and FMLA
- Train managers on the interplay between federal and state laws
We also provide subject-matter counseling to solve workplace challenges covering the entire range of labor and employment issues, such as: hiring, FCRA compliance; workforce reductions; ADA, FMLA and state leave management; wage and our exempt status, independent contractor and pay practices audits; eDiscovery systems and processes; and anti-harassment and other employment law training.
This group of practitioners is often called upon to draft non-competition agreements, non-disclosure agreements, executive employment agreements, separation agreements, resignation and releases.
